45 States Have Enacted Statutes Similar to the UTSA

Historically, trade secrets have been protected under various state laws, whereas patents (Patent Act), copyrights (Copyright Act of 1976), and trademarks (Lanham Act) are protected by federal legislation. However, due to the efforts of the National Conference of Commissioners on Uniform State Laws, statutes modeled after the Uniform Trade Secrets Act have now been enacted in 45 states and the District of Columbia.

There is one state that has enacted its own statutes protecting trade secrets: Massachusetts.

There are four states that protect trade secrets under the common law: New Jersery, New York, Texas and Wyoming.

There are 45 states that have enacted statutes modeled after the UTSA:
